Bar and tavern owners who say Colorado's smoking ban is pushing them out of business asked a federal appeals court Thursday to overturn the ban.

Seeder's Note: We are a world of extremes. We have smoking everywhere - or it's nowhere. I propose a middle ground. Treat smoking as we treat alcohol: if you want to have smoking at your establishment, you have to purchase a smoking license. There would be a review of your establishment to determine if it was appropriate for smokers: i.e. Chuck E Cheeses would probably be determined not appropriate for smokers. However, bars and other 18+ hangouts should have the right to offer smoking if they choose. However, there should be a price.

This is the middle ground I propose as an (asthmatic) non-smoker - any smokers like to weigh in?
